Warranty and Guarantee:

Work performed by Paul Lynch Cable is warranted for one year. Equipment purchased and installed by Paul Lynch Cable is warranted for the time suggested by the manufacturer and is valid only from the date of purchase unless otherwise stated in contract if extended warranties are purchased. All work executed by Paul Lynch Cable under this section is free from defects of material and workmanship for a period of one (1) year from the date of final acceptance. During the time of this guarantee, the repair and/or replacement of any defective work shall be made at no additional cost to the owner.

4. Payment and Billing: Paul Lynch Cable reserves the right to correct it’s proposal for errors and omissions.

  1. Fifty Percent (50%) deposit is expected before work begins.
  2. Fifty Percent (50%) of the remaining balance after Rough In.
  3. The remainder is due after the project has been completed and the network is handed over to the owner unless work being performed calls for Progressive Payments.
  4. There will be a $250.00 a day late fee for each day after the invoice due date. Invoice payment is due upon receipt.

5. Liability Insurance: Mention any liability insurance coverage your company may have, and clarify the extent of your liability in case of damage or loss related to your services.

6. Termination of Services:

1. Termination by Paul Lynch Cable:

a. Paul Lynch Cable reserves the right to terminate its services to the client under the following circumstances:

    • Breach of Agreement: If the client breaches any material terms or obligations set forth in this agreement, including non-payment of fees, Paul Lynch Cable may terminate services immediately upon written notice to the client.
    • Failure to Cooperate: If the client fails to cooperate, provide necessary information, or grant access required to perform structured cabling services adequately, Paul Lynch Cable may terminate services after providing reasonable notice.
    • Safety and Legal Concerns: If safety concerns or legal issues arise during the provision of services, Paul Lynch Cable may suspend or terminate services to protect the safety and well-being of its employees, subcontractors, or the general public.
    • Completion of Services: Upon successful completion of the structured cabling services outlined in the agreement, services will automatically terminate unless otherwise agreed upon in writing.

2. Termination by the Client:

a. The client may terminate services with Paul Lynch Cable under the following conditions:

    • Non-Performance: If Paul Lynch Cable fails to perform its obligations under this agreement, and such non-performance is not remedied within a reasonable period after written notice from the client, the client may terminate the agreement.
    • Convenience: The client may terminate services for any reason with prior written notice to Paul Lynch Cable. In such cases, the client may be responsible for any fees or costs incurred up to the termination date.

3. Effect of Termination:

a. Upon termination of services for any reason:

    • All outstanding fees, costs, or expenses owed by the client to Paul Lynch Cable shall become immediately due and payable.
    • The client shall promptly return any equipment, materials, or documentation provided by Paul Lynch Cable for the provision of services.
    • Any warranties or guarantees provided by Paul Lynch Cable shall be subject to the terms specified in the agreement.

4. Dispute Resolution:

a. In the event of a dispute related to the termination of services, both parties agree to follow the dispute resolution procedures outlined in these terms of service.

5. Notice of Termination:

a. All notices of termination shall be in writing and delivered to the respective party’s address as provided in this agreement. One such letter should be by Certified signature returned receipt mail.

a. The obligations of confidentiality shall not apply to information that:

a. The obligation of confidentiality shall continue beyond the termination of employment or contractual relationship with the Company and shall remain in effect indefinitely.

a. This confidentiality agreement shall be governed by and construed in accordance with the laws of the jurisdiction of Middlesex County New Jersey and Edison New Jersey 08817 and the resident state, The State Of New Jersey.

8. Dispute Resolution: Whether through negotiation, mediation, or arbitration; Any remediation process due to a lack of contract payment including and not limited to attorney costs and fees will be the responsibility of the Owner/GC for the location indicated in the Contract Document.

Paul Lynch Cable shall comply with The State Of New Jersey Uniform Construction Code, NJ IBC (2009), The National Electric Code, all applicable requirements of the Occupational Safety and Health Act (OSHA) and The American National Standard Institute (ANSI/ICC) codes 2009 subchapter 7.
